These Terms & Conditions ("Terms") govern your access to and use of the website at https://profiles.link and any related services (collectively, the "Service"), operated by Arowana Scrinium Branding LLC ("Profiles.Link", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Your account

  • You are responsible for the information you provide and for keeping your login credentials secure. We recommend enabling two-factor authentication.
  • You are responsible for all activity that occurs under your account.
  • You must notify us promptly of any unauthorized use or security breach.
  • One person or entity may not maintain multiple accounts to evade limits, suspensions, or fees.

3. Acceptable use

You agree not to use the Service to publish, link to, sell, or distribute any content that:

  • is illegal, infringing, defamatory, harassing, hateful, or threatening;
  • sexually exploits or endangers minors;
  • contains malware, phishing, deceptive redirects, or links on our denylist;
  • infringes anyone's intellectual-property, privacy, or publicity rights;
  • promotes fraud, illegal gambling, illegal drugs, weapons, or other unlawful goods or services;
  • impersonates another person or misrepresents your affiliation.

You also agree not to: probe, scan, or test the vulnerability of the Service; circumvent security or rate-limiting; scrape or harvest data; overload our infrastructure; reverse-engineer the Service; or use it in any way that violates applicable law. We may remove content, block links, and suspend or terminate accounts that breach this section.

4. Your content

You retain ownership of the content you upload or create (profile text, images, links, products, and other materials, your "Content"). By submitting Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that Content as necessary to operate and promote the Service. You represent that you have the rights necessary to grant this license and that your Content does not violate section 3.

You are solely responsible for your Content and for any links you publish, including the destinations they point to.

5. Public profiles

Profiles are public by default and may be indexed by search engines and listed in the public directory. You can change visibility (public / unlisted / private), disable search indexing, and opt out of the directory in your profile settings. You are responsible for what you choose to make public.

6. Stars (virtual currency)

  • "Stars" are a virtual, in-platform currency used to pay for plans, features, themes, tips, digital products, verification, and transfers.
  • Stars have no monetary value outside the Service, are not legal tender, are not a bank deposit or e-money, and (except where required by law) cannot be redeemed for cash.
  • We may set, change, or remove star prices, packages, bonuses, transfer fees, and earning rules at any time. Promotional or bonus stars may expire or carry conditions.
  • Star purchases are generally final and non-refundable except where required by law (see section 10).
  • We may adjust, freeze, or reverse star balances and transactions to correct errors, reverse fraudulent or unauthorized activity, or enforce these Terms.

7. Payments, plans & subscriptions

  • You can buy stars using the payment methods offered at checkout (for example card payments via our processors, or offline/bank transfer). Payment-card details are handled by our processors, not by us.
  • Pro plans and per-feature subscriptions are billed in stars. A feature subscription renews automatically approximately one month after purchase, debiting your star balance, until you cancel.
  • Negative balance & suspension: if a renewal cannot be paid because your balance is too low, your balance may go negative and you enter a grace period (currently [7] days). If you do not top up before the grace period ends, your public profile may be suspended until your balance is positive again.
  • Cancelling a subscription stops future renewals; it does not refund the current period, and access continues until the paid period ends.
  • You authorise these recurring star debits when you subscribe.

8. Tips, digital products & transfers

  • The Service lets creators receive tips and sell digital products for stars, and lets users transfer stars to each other (a transfer fee may apply).
  • For tips and product sales, the transaction is between the supporter/buyer and the creator. Profiles.Link provides the technical means only and is not a party to that transaction.
  • Creators are solely responsible for the products they sell, for delivering what they promise, for the lawfulness of their offerings, and for any taxes arising from money or stars they receive.
  • Tips and transfers are generally final. We are not responsible for mistaken transfers between users.

9. Verification badge

A verified badge (where offered) indicates that we performed a basic review of the information submitted. It is not an endorsement, a guarantee of identity, or a warranty of any kind. We may grant, decline, or revoke verification at our discretion. Verification fees are charged in stars and are non-refundable once a request has been reviewed.

10. Refunds

Except where a non-waivable consumer right applies in your jurisdiction, all purchases — star packs, plans, features, themes, verification, tips, and products — are final and non-refundable. Where you have a statutory right to cancel or to a refund, that right is unaffected by these Terms. To request a refund you believe you are entitled to, contact us at support@profiles.link or open a support ticket.

11. Third-party services and links

The Service integrates third-party providers (for payments, email delivery, hosting, and asset delivery) and lets you publish links to, and embed content from, third-party sites. We do not control and are not responsible for third-party services or destinations, their content, or their practices. Your use of them is at your own risk and subject to their terms.

12. API and webhooks

If you use our API or outbound webhooks, you must keep your API keys and webhook secrets confidential, comply with any rate limits, and only send data to endpoints you control or are authorized to use. We may change, rate-limit, or discontinue the API at any time.

13. Our intellectual property

The Service itself — including its software, design, logos, and branding (other than your Content and third-party marks) — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, if required by law, to protect the Service or other users, or if your account remains in a negative or suspended state. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnity) will survive.

15. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data, analytics, or email delivery will be accurate, timely, or complete.

16. Limitation of liability

To the maximum extent permitted by law, Profiles.Link and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or stars, arising from or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the [12] months before the claim, or (b) [USD 100 / your chosen cap]. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Profiles.Link and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your Content, your use of the Service, your products or tips, or your breach of these Terms or of any law or third-party right.

18. Changes to the Service and these Terms

We may modify or discontinue the Service (or any feature) at any time. We may also update these Terms from time to time; when we make material changes we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the revised Terms.

19. Governing law and disputes

These Terms are governed by the laws of [YOUR JURISDICTION], without regard to its conflict-of-laws rules. You agree that the courts of [YOUR JURISDICTION] will have exclusive jurisdiction over any dispute, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.

20. Miscellaneous

  • If any provision of these Terms is found unenforceable, the rest remain in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
