1. Acceptance of These Terms

These Terms of Use ("Terms") govern access to and use of Profiles.Link, including the Profiles.Link website, digital profiles, business engagement tools, subscriptions, payment-related features, organizational services, APIs, integrations and other features made available through the platform (collectively, the "Services").

By creating an account, purchasing or activating a paid feature, or otherwise using the Services, you agree to these Terms and to the  Privacy Policy  published on Profiles.Link. If you do not agree, you must not use the Services.

Additional terms may apply to particular paid features, APIs, promotions, organizational services or third-party integrations. If additional terms conflict with these Terms, the additional terms will govern only for the relevant feature or service, to the extent permitted by applicable law.

2. Eligibility and Legal Age

You may use Profiles.Link only if you have reached the legal age of majority under the laws applicable to you, have the legal capacity to enter into a binding agreement, and are not prohibited from using the Services under applicable law.

Profiles.Link is not intended for minors or for persons who have not reached the applicable legal age of majority. If the law applicable to you requires a higher age, additional authorization or another legal condition for entering into these Terms, you must satisfy that requirement before using the Services.

If you create, administer or use an account on behalf of a company, organization or other legal entity, you represent and warrant that you are authorized to act for and bind that entity to these Terms.

3. The Profiles.Link Services

Profiles.Link is a digital identity and business engagement platform. Depending on account type, plan, jurisdiction and feature availability, the Services may enable users to create and customize digital profiles; present professional, business and contact information; add websites, social links, app links and service information; control profile visibility; share profiles through direct links, QR codes or NFC; schedule appointments; review profile and link analytics; manage advanced link behavior; offer digital products or services; receive payments; use internal platform credits; and access organization-level features.

Certain features may be restricted to specific plans, account types, eligible company profiles or jurisdictions. Features may be introduced, improved, modified, suspended or discontinued as the platform evolves, subject to applicable law and any commitments made for paid services.

4. Account Registration and Security

You must provide accurate, current and complete information when creating and maintaining an account. You must not create an account using false or misleading information, impersonate another person or entity, or use an account for fraudulent, deceptive or unlawful purposes.

You are responsible for maintaining the confidentiality and security of your credentials and for activity carried out through your account, except to the extent caused by a failure for which Profiles.Link is legally responsible. You must promptly notify Profiles.Link if you reasonably believe that your account has been accessed without authorization.

Profiles.Link may use security measures such as re-authentication, two-factor authentication where available, fraud detection and human-versus-bot verification. Human-versus-bot controls may be applied during registration, login, password-reset requests or other security-sensitive actions.

5. Profiles, Visibility and Organization Accounts

You are responsible for the accuracy, legality and currency of information displayed on your profile. Depending on the available settings, a profile may be public, private, password-protected or unlisted, and users may control the visibility of profile information.

Public profiles may be accessible through a direct link and may be discoverable through Profiles.Link search or through third-party search services, subject to applicable settings and indexing behavior outside Profiles.Link's control.

Organizations may link employee or member profiles, apply organization branding and manage organization-related information centrally. If your profile is linked to an organization, certain organization-controlled information or branding may be managed by an authorized organization administrator. Organizations and their administrators are responsible for ensuring that they have authority and a lawful basis to manage information relating to employees or members.

6. Company Verification

Profiles.Link may offer formal verification for eligible company profiles. Verification may require corporate records, licensing information, proof of authority or other evidence reasonably necessary to confirm the existence or status of the company.

Successful verification may result in a verification badge or other indicator. A badge means only that the applicable Profiles.Link verification process was completed; it is not a government certification, guarantee, recommendation, credit assessment or endorsement of the company, its owners, products or services.

Profiles.Link may refuse, suspend or revoke verification where information is inaccurate, incomplete, outdated, misleading, fraudulent or no longer satisfies the applicable verification requirements. Verification fees and any applicable refund conditions will be disclosed at or before purchase and remain subject to mandatory law.

Unless Profiles.Link expressly states otherwise, registration of a personal or professional profile does not constitute formal identity verification of that individual.

7. User Content and Rights

You retain ownership of content and materials that you upload, submit, display or make available through Profiles.Link ("User Content"), including profile text, photographs, logos, links, media and business information.

You grant Profiles.Link a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display and technically adapt User Content only as reasonably necessary to provide, secure, maintain and improve the functionality of the Services and to display the content according to your selected profile settings.

You represent and warrant that you have the rights, permissions and lawful basis required to provide and use your User Content and that it does not infringe intellectual property, privacy, publicity, confidentiality or other rights of any person.

Profiles.Link may remove or restrict User Content where reasonably necessary to enforce these Terms, protect users or the platform, respond to a valid rights complaint, or comply with law.

8. Acceptable Use

You must use Profiles.Link lawfully and responsibly. You must not use the Services to:

  • violate applicable law, regulation, sanctions or legally binding restrictions;
  • impersonate another person, company or organization or misrepresent affiliation or authority;
  • engage in fraud, phishing, deception, scams or misleading commercial practices;
  • upload malware, malicious code or content intended to compromise devices, accounts or systems;
  • send spam or unsolicited bulk communications;
  • harvest, scrape or systematically collect personal information or platform data without lawful authority and      Profiles.Link's permission where required;
  • attempt to bypass security, authentication, access controls, rate limits or technical restrictions;
  • interfere with, overload, disrupt or compromise the availability or security of the Services;
  • infringe intellectual property, privacy, confidentiality, publicity or other rights;
  • publish unlawful, defamatory, threatening, harassing, exploitative or intentionally harmful content;
  • promote, offer or facilitate unlawful products, services or activities;
  • use Profiles.Link data to create unauthorized databases, competing services, profiling systems or artificial-intelligence training datasets; or
  • use routing, advertising, analytics or engagement tools in a manner that is unlawful, deceptive or discriminatory.

9. Links, QR Codes and NFC

Profiles.Link may allow profiles to be shared through URLs, QR codes and NFC-compatible methods. You are responsible for ensuring that the destination links, content and information associated with your profile are accurate, lawful and safe.

NFC compatibility may depend on third-party devices, tags, browsers, operating systems or hardware outside Profiles.Link's control. Unless expressly offered by Profiles.Link, the Services do not include the manufacture, sale or management of physical NFC cards or tags.

10. Appointment Scheduling and External Meeting Services

Profiles.Link may provide appointment-scheduling tools that allow profile owners to define availability and visitors to request or book available time slots.

Profiles.Link provides scheduling technology but is not a party to the professional, commercial or personal relationship between the participants. Users remain responsible for availability, attendance, qualifications, professional obligations, fees and any service provided in connection with an appointment.

Profiles.Link does not currently represent that it operates an internal video-meeting service. Where a profile or appointment uses a link to an external video-meeting or communications provider, that third-party service is governed by its own terms, privacy practices and availability.

11. Digital Products, Services and User Transactions

Where enabled, eligible users may offer digital products or services through Profiles.Link. Unless Profiles.Link expressly identifies itself as the seller or service provider for a specific transaction, the user offering the product or service is responsible for its description, legality, quality, delivery, required licenses, customer obligations, taxes and compliance with applicable refund or cancellation rules.

Users must not offer prohibited, unlawful, infringing, deceptive or regulated products or services through Profiles.Link. Profiles.Link may restrict or remove listings or transaction capabilities where necessary for legal, security, payment-risk or platform-integrity reasons.

Disputes between users concerning a product, service or appointment should first be addressed between the relevant users, without limiting any rights or responsibilities that applicable law places directly on Profiles.Link.

12. Payments, Payment Providers and Taxes

Payments may be processed through third-party payment providers. Payment providers may require separate terms, identity or payment verification, and may independently apply fraud, chargeback, sanctions or risk controls.

Profiles.Link may suspend or restrict payment-related functionality where reasonably necessary to prevent fraud, manage chargebacks, protect users, satisfy payment-provider requirements or comply with law.

Unless otherwise stated, prices displayed by Profiles.Link will be presented before purchase. Taxes, currency conversion, bank charges or payment-provider fees may apply depending on the transaction and jurisdiction. Users who sell products or services are responsible for taxes and regulatory obligations applicable to their own sales, except where the law requires Profiles.Link or a payment provider to collect, report or remit them.

13. Stars - Internal Platform Credits

Profiles.Link may provide internal platform credits known as "Stars". Stars are designed solely for use within the Profiles.Link ecosystem and are not currency, cryptocurrency, e-money, a bank deposit, a security or an investment product.

Subject to platform rules, individuals may purchase and use Stars for eligible Profiles.Link features or transactions. Companies and organizations may also fund or purchase Stars and allocate or transfer them to eligible employees or members, allowing approved platform costs to be managed centrally rather than requiring each individual to pay personally.

Transfers or other sensitive Stars transactions may require re-authentication or additional security verification. Profiles.Link may apply limits or restrictions to purchases, transfers or usage for security, compliance, fraud-prevention or operational reasons.

Stars do not have a cash-redemption right unless Profiles.Link expressly provides one or applicable law requires one. Any price, permitted use, transfer rule, expiry rule (if any), refund condition or other material condition applicable to Stars will be disclosed through the platform or at the relevant point of purchase.

14. Subscriptions, Premium Features and Pricing

Profiles.Link may offer free plans, Pro/Premium plans, premium themes, separately purchased features and other paid services. The price, billing period and material conditions will be shown before purchase.

If a subscription is offered on an automatically renewing basis, the renewal period, applicable price and available cancellation method will be disclosed at or before purchase. If a subscription is not auto-renewing, access will expire or change in accordance with the plan terms shown to the user.

Profiles.Link may change prices prospectively. Where required by applicable law, material changes affecting an existing recurring subscription will be communicated in advance and users will be given any cancellation or other rights required by law.

15. Cancellations and Refunds

Cancellation and refund rights depend on the type of purchase, whether performance or digital delivery has begun, the applicable payment-provider rules and mandatory consumer law.

Any specific refund conditions for subscriptions, premium features, themes, verification, Stars, digital products or other paid services will be displayed at or before purchase or in a separate refund policy made available through Profiles.Link.

Nothing in these Terms excludes or limits any cancellation, refund, withdrawal, chargeback or consumer right that cannot lawfully be excluded or limited.

16. Lead Capture, Marketing and Communications by Users

Profiles.Link may provide features that allow eligible users to collect contact details or leads. If you use those features, you are responsible for providing any legally required notices, obtaining any required consent, respecting marketing preferences and complying with applicable privacy, electronic communications, anti-spam and direct-marketing laws.

You may not use contact information obtained through Profiles.Link for unlawful, misleading, abusive or unsolicited marketing.

17. Analytics and Measurement

Profiles.Link may provide profile views, link clicks, visitor insights, engagement measurements or other analytics. Analytics are provided for informational and operational purposes and may be affected by privacy settings, browser behavior, network conditions, filtering, technical limitations or third-party systems.

Profiles.Link does not guarantee that analytics represent every view, visitor, click, conversion or interaction with absolute accuracy.

18. Intellectual Property

Profiles.Link, its software, platform architecture, interfaces, designs, trademarks, logos, databases, documentation and other proprietary materials are owned by or licensed to AROWANA SCRINIUM BRANDING SERVICES L.L.C. and are protected by applicable intellectual-property laws.

Except for the limited right to use the Services in accordance with these Terms, no intellectual-property rights are transferred to you. You may not copy, reproduce, modify, reverse engineer, resell, sublicense or commercially exploit the Services except where expressly authorized or where applicable law does not permit the restriction.

If you believe content on Profiles.Link infringes your intellectual-property rights, you may contact Profiles.Link using the details in Section 31 and provide sufficient information to identify the work, the allegedly infringing material and your authority to make the complaint.

19. Privacy and Data Protection

Profiles.Link's processing of personal data is governed by the Profiles.Link Privacy Policy and applicable data-protection law.

If you provide personal information relating to employees, members, customers, leads or other third parties, you are responsible for ensuring that you have a lawful basis and any required notices, permissions or consents to provide and use that information through the Services.

Organization administrators must use access to employee or member information only for authorized organizational purposes and in accordance with applicable privacy and employment laws.

20. Third-Party Services and Integrations

Profiles.Link may contain links to or integrations with third-party websites, applications, payment providers, social networks, analytics services, communications tools or other services.

Profiles.Link does not control third-party services and is not responsible for their independent content, availability, security, terms, privacy practices or conduct. The fact that a third-party service can be accessed or integrated through Profiles.Link does not constitute an endorsement or guarantee of that service.

You should review the terms and privacy policies of third-party services before using them.

21. API and Webhook Use

Where Profiles.Link provides APIs, webhooks or integration credentials, you must use them only for authorized purposes, protect credentials against unauthorized access, comply with technical limits and security requirements, and not use integrations to circumvent these Terms or access data you are not authorized to receive.

Profiles.Link may change, restrict, rotate or revoke API or webhook access where reasonably necessary for security, platform stability, compliance or misuse prevention. Additional developer or integration terms may apply.

22. Suspension, Restriction and Termination

Profiles.Link may suspend, restrict or terminate an account or specific feature where reasonably necessary because of a material violation of these Terms; suspected fraud or unlawful activity; threats to platform security; infringement of third-party rights; non-payment; misuse of payment or Stars functionality; legal or regulatory requirements; or a material risk to users, the platform or third parties.

Where reasonably possible and legally appropriate, Profiles.Link will provide notice of material enforcement action. Users may contact support to request review of an enforcement decision.

You may close your account using the account-deletion methods made available by Profiles.Link. Data retention, deletion and legal preservation following closure are governed by the Privacy Policy and applicable law.

23. Service Availability, Maintenance and Changes

Profiles.Link aims to provide reliable Services but does not guarantee uninterrupted or error-free operation. Temporary interruptions may result from maintenance, updates, cybersecurity events, internet or hosting infrastructure, third-party services, force majeure or circumstances outside reasonable control.

Profiles.Link may modify technical requirements, functionality or service availability where reasonably necessary for security, performance, legal compliance, product development or operational reasons. Where a material change significantly affects a paid service, Profiles.Link will provide any notice, credit, refund or other remedy required by applicable law or the applicable purchase terms.

24. No Guarantee of Business Results

Profiles.Link provides digital tools and does not guarantee that a profile will receive any particular number of visitors, contacts, appointments, customers, sales, payments, leads, professional opportunities or other business results.

Any examples, analytics, projections or performance information are not promises of future results. Your results depend on factors outside Profiles.Link's control, including your content, market conditions, audience, pricing, availability and third-party services.

25. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as available" basis. Profiles.Link does not warrant that the Services will be uninterrupted, error-free or compatible with every device, browser, network, third-party service or use case.

Profiles.Link does not warrant the accuracy, legality, quality or reliability of information, products, services or content provided by users or third parties.

Nothing in these Terms excludes any warranty, guarantee or consumer protection that cannot lawfully be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, AROWANA SCRINIUM BRANDING SERVICES L.L.C. and Profiles.Link will not be liable for indirect, incidental, special, exemplary or consequential losses, or for loss of profits, business opportunities, goodwill or data, arising from use of the Services, third-party services, User Content or transactions between users, except where such limitation is prohibited by law.

For claims for which liability may lawfully be limited, aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid directly to Profiles.Link during the 12 months preceding the event giving rise to the claim or (b) USD 100, unless a different limitation is required by applicable law.

These limitations do not apply to liability that cannot legally be excluded or limited.

27. Indemnity for Business and Professional Users

To the extent permitted by law, users acting for business or professional purposes agree to indemnify and hold harmless AROWANA SCRINIUM BRANDING SERVICES L.L.C. from third-party claims, losses or reasonable costs arising from unlawful User Content, infringement of third-party rights, unauthorized organization administration, unlawful products or services offered by the user, or a material breach of these Terms.

This Section does not limit mandatory rights or protections available to consumers.

28. Electronic Communications and Notices

By using Profiles.Link, you agree that operational, contractual, security and service-related notices may be provided electronically, including through the platform or by email to the address associated with your account, to the extent permitted by applicable law.

You are responsible for maintaining an accurate email address and reviewing notices delivered to your account. Marketing communications will be handled in accordance with applicable law and your available preferences.

29. Changes to These Terms

Profiles.Link may update these Terms to reflect changes in the Services, law, security requirements, payment arrangements or business operations.

Where required, material changes will be communicated through the platform, by email or by another reasonable method before they take effect. Continued use after the effective date of updated Terms constitutes acceptance only to the extent permitted by applicable law. Where renewed consent is legally required, Profiles.Link will request it.

30. Governing Law, Jurisdiction and Mandatory Rights

These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai, without prejudice to mandatory laws that apply to you and cannot lawfully be excluded by contract.

Subject to mandatory consumer-jurisdiction rules and other rights that cannot be waived, disputes arising out of or relating to these Terms or the Services will be subject to the competent courts of Dubai, United Arab Emirates.

If you are a consumer, nothing in this Section removes any non-waivable rights or remedies available under the mandatory law of your place of residence.

31. General and Contact Information

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without written consent, except where applicable law provides otherwise.

These Terms, together with the Privacy Policy and any additional terms presented for a specific paid feature or service, form the agreement governing your use of Profiles.Link.
